Learned advocate appearing for the petitioner prays for bail as he is in custody since 28th September, 2024. Learned advocate submits that out of 14 witnesses cited by the prosecution, till date only one witness has been examined and the evidence of the second witness is in progress. Learned advocate prays for bail as the petitioner is in custody for more than 1 year 8 months. Learned advocate for the State opposes the prayer for bail detailing the complicity of the present petitioner. It has also been pointed out that another accused approached the Hon'ble Supreme Court and the prayer for bail of the said accused, namely, Krishna Sngha @ Krishna Singha has been rejected in Special Leave to Appeal (Crl.) No(s).17469 of 2025. Records of the said bail order reflects that the Hon'ble Apex Court has categorically observed that
in the event the trial is not concluded within the aforesaid period of one year for no reason or fault attributable to the petitioners, the petitioners shall be at liberty to revive their prayer for bail. The time frame provided by the Hon'ble Apex Court till date has not been completed. As such, at this stage, I am not inclined to release the petitioner on bail considering the huge quantity of recovery in this case.
Thus, CRM (NDPS)1137 of 2026 is dismissed at this stage.
