Kausik (Allowed) CRM (M) 1318 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Canning Police Station Case No. 179 of 2016 dated 22.03.2016 under section 323, 363/120B, 366A/120B, 368, 370, 370-A, 372, 373, 506(II) of the Indian Penal Code and Section 6/17 of the POCSO Act, 2012.

Learned advocate appearing for the petitioner submits that the petitioner was arrested on 26th July, 2016 and since then he is in custody. Attention of the Court has been drawn to the prescribed punishments for which the petitioner has been charged.

Learned Additional Public Prosecutor opposes the prayer for bail.

In view of the fact that after examination of the accused persons under Section 313 of the Cr.P.C. was allowed in a revisional application, a direction was passed for cross-

examination of the victim girl and the said revisional application was at the behest of the present petitioner. Be that as it may, 9 years 11 months is a long passage of time which do reflect a slow progress of the case. Having considered the said period for which the petitioner is in custody, without entering into the merits of the case, I am inclined to release the petitioner on bail.

Accordingly, Petitioner, namely, Firoj Ali @ Babu @ Bablu shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Alipore.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas South without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1318 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
