Saha ... for the Petitioner(s) Mr. Paramanda Sharma, APP Mr. Anurag Sardar ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner was arrested on 30th October, 2021 and since then he is in custody for more than four and half years. Learned advocate added that till date out of the 16 charge-sheeted witnesses, only three witnesses have been examined. Learned advocate for the State opposes the prayer for bail and produces the case diary.

Having considered the period of detention, without entering into the merits of the case as also taking into account the manner in which the offence has been committed but only on the ground of delayed trial, the present petitioner is being released on bail. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Palash Kahar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, North 24 Parganas, Barasat.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of North 24 Parganas without prior intimation to the learned trial court. Further, the petitioner shall once in a month attend the Amdanga Police Station for a period of six months. However, it would be the discretion of the learned trial court to either extend such condition and/or waive such condition at the expiry of the aforesaid time period.

Accordingly, CRM (M) 1319 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
