Learned advocate appearing for the petitioner submits that the petitioner is in custody since 09.11.2022 and till date, only six witnesses have been examined out of the cited 22 witnesses.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and tries to emphasize the Court on the issue relating to the gravity of the offence as it is the petitioner who inflicted the vital blows and the death was because of the stab injury sustained by the deceased. According to the State, petitioner is solely responsible for commission of the offence and the offence being a heinous one, petitioner should not be released on bail. I have taken into account the materials appearing in the case diary, the time which has been consumed till date as well as some of the evidence which has been recorded. I

also do not find from the materials produced before this Court that there is any antecedent of the present petitioner. As such, considering the only issue relating to the period of detention of the present petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Raja Mondal alias Babu shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24-Parganas. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of North 24Parganas without prior permission of the learned Trial Court. Additionally, the learned Trial Court would be at liberty to impose any condition as it deems fit and proper for smooth progress of the trial of the case.

The application for bail, being CRM (M) 1320 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
