Petitioner is aggrieved by the fact that the he and 23.06.2025 Court No. 35 Item No.59 Rakib his mother have been mercilessly assaulted and it has also been alleged that the petitioner's mother was subjected to molestation at the behest of the private respondents. Petitioner lodged a complaint but in spite of the same no steps were taken.

Having considered the report which has been submitted by the police authorities and a notice so issued, I find that the petitioner insist on the fact that since injuries were inflicted and offences complained of are cognizable in nature case be registered. However, the police authorities did not find any cognizable offence having been made out and was of the opinion that there was a matrimonial dispute which is the genesis of all the subsequent events.

Be that as it may, in view of the nature of the accusations petitioner would approach the jurisdictional Magistrate, learned jurisdictional Magistrate would assess regarding the correctness of the accusations ascertain

whether a case for investigation has been made out and thereafter pass necessary directions as he deems fit and proper.

Accordingly, WPA 11796 of 2025 is disposed of. Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
