Fortunately, it appears that the dispute between the petitioner and the college has been resolved. Petitioner, by a letter dated July 11, 2022, wrote before the college as follows :
" I submit that in this current scenario, I would like to forget all the bitterness between, me and the college authority that happened in part and I am willing to continue and/or resume my service in this college forthwith.
I further say that during my service there if anybody of the college authority has been hurt by my behaviour, though I have not done anything wrong consciously, I am hereby tendering my apology.
I am looking forward to serve the college with the best of my ability in future."
In that view of the letter, the college has decided to allow the petitioner to join her duty on and from July 13, 2022 and a joining letter has been issued in her favour on July 11, 2022.
It has been submitted by Mr. Srijib Chakraborty, learned advocate appearing for the College that college will send all necessary papers to Director of Public Instruction, West Bengal for approval of the service of the petitioner.
Mr. Chakraborty, however, submits that the petitioner even thereafter has sent an e-mail to the college requesting them to omit the word 'unconditional' from the joining letter issued by the college on July 11, 2022.
No doubt the e-mail of the petitioner creates further complications.
The learned advocate for the petitioner, however, submits that the petitioner will join on the same terms and conditions as indicated in the joining letter dated July 11, 2022.
Needless to mention that if there is any behavioral impropriety or otherwise misconduct on behalf of the petitioner, college may take necessary steps in accordance with law.
I do not see any reason to keep this writ petition pending.
Accordingly, WPA 11176 of 2022 is disposed of. Let urgent certified copies of this order, if applied for, be given to the parties upon compliance with all the necessary formalities.
