IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction CRR 1151 of 2013 In the matter of : Uttam Kumar Das & Ors.

.....petitioners.

In Re : An application under Section 482 of the Code of Criminal Procedure. Mr. Arijit Ganguly Mrs. Debjani Sahu ................for the State.

The present revisional application has been preferred challenging the proceedings relating to Kulti P. S. Case No. 406 of 2011dated 15.12.2011 under Sections 498A/323/34 of the Indian Penal Code and all orders passed therein. The present petitioners happen to be the husband, brother-in-law, wife of brother-in-law and the husband of the sister-in-law.

The record of this revisional application reflects that so far as the present petitioner no. 1 is concerned i.e., husband the revisional application was dismissed by a co-ordinate Bench of this court 0n 09.04.2013. However, so far as the other petitioners are concerned, there was an interim order for a limited period of time. The same was extended by an order dated 14.02.2014 till end of March, 2014. The petitioners approached this court at a stage when dates were fixed for consideration of charge. I also do not find in the revisional application that any of the documents under Section 207 of the Code of Criminal procedure being enclosed.

As none appeared on behalf of the State, Mrs. Debjani Sahu, learned advocate who ordinarily appears on behalf of the State was directed to represent the State. Her appointment may be regularized by the concerned Authorities in due course.

Regarding the fact that the stage at which the petitioners approached this court and the observations made above, I am of the opinion that the petitioners have failed to make out any case for interference.

Accordingly, the revisional application being CRR 1151 of 2013 is dismissed.

All pending applications, if any, in connection with the revisional application, are consequently disposed of.

Interim order, if any, is hereby vacated.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
