Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 3 months. There was recovery of 163.700 kgs. of Ganja from a secret chamber of the vehicle (pick up van). Petitioner claims to be a passenger in the said pick up van and submits that there was a subsequent recovery of additional 26 kgs. of Ganja from the driver who fled away from the spot which reflects complete complicity of the driver in the present case and the petitioner is innocent of the charges.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail particularly in respect of the huge quantity of contraband which has been seized. I have taken into account the quantum of seizure and the fact that charges have been framed and one witness has already been examined. Prosecution intends to examine 16

witnesses. There are six seizure list witnesses as submitted by the learned advocate for the State. So far as the evidence of seizure list witnesses is concerned, the same be completed within a period of five months from the date of communication of this order.

At this stage, the prayer for bail of the petitioner is rejected.

The petitioner would be at liberty to approach this Court after the evidence of seizure list witnesses is over. The application for bail, being CRM (NDPS) 1148 of 2026, is, thus, disposed of.
