Bhattacharyya Heard on : 25.09.2025 Judgment on : 25.09.2025 Jay Sengupta, J.: Learned counsel appearing for the petitioner submits that the petitioner had been a mental patient for the last 16 years. That is why, there is a delay in challenging the order of issuance of warrant of arrest.

Heard the learned counsels for the parties in respect of the application for condonation of delay.

In view of the explanation provided, I am inclined to allow the application for condonation of delay. Delay is condoned. Accordingly, the CRAN 1 of 2025 is disposed of. Learned counsel appearing for the petitioner submits that the petitioner was regularly attending the Court after obtaining the bail. Due to his mental condition, the petitioner could not attend Court subsequently. Learned counsel appearing for the State submits that the petitioner should join the proceedings at the earliest.

Considering the exceptional circumstances that the petitioner had been suffering from mental illness for a considerable period and in the interest of justice, I grant liberty to the petitioner to surrender before the said Court within six weeks and pray for bail and in such event the application for bail shall be considered in accordance with law. The warrant of arrest shall remain stayed for six weeks. Accordingly, the revisional application is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Jay Sengupta, J.)
