Learned advocate appearing for the petitioner submits that the petitioner was arrested on 7th July, 2025 and since then he is in custody for more than 11 months. There were alleged recovery of 26 kgs. of ganja and the petitioner was roped in the case where there was a seizure of 163.7 kgs. of ganja. The said complicity was on the basis of the statement of the co-accused. Learned advocate for the State submits that there has been huge recovery in the present case from the secret chamber of a pickup van and further recovery was from the house of the petitioner.

I have taken into account the huge quantum of seizure in the present case as also the period of detention of the petitioner which is more than 11 months. Charges have already been framed.

The evidence of P.W.1 is complete and the prosecution intends to examine 16 witnesses in support of its case.

Having considered the totality of the circumstances, at this stage, I am not inclined to release the petitioner on bail. Petitioner would be at liberty to renew his prayer for bail after the evidence of the seizure list witnesses are over. It has been pointed out that there are six seizure list witnesses.

Considering the same, learned trial would complete the seizure list witnesses within a period of five months as has been directed in another case.

With the aforesaid observations, CRM(NDPS) 1159 of 2026 is dismissed at this stage.
