Bihani Mr. Soumya Mukherjee ...for the CSTC Mr. Avishek Prasad ...for the State The petitioner retired as a Senior Fuel Assistant from Calcutta State Transport Corporation (CSTC) with effect from October 31, 2022. The grievance of the petitioner is that the petitioner only received 40% of the provident fund dues. Remaining 60% of the provident fund dues are yet to be paid. The total quantum of provident fund dues payable to the petitioner is Rs.24,18,784/-. Such amount is not in dispute.

Mrs. Dey (Basu), learned counsel represents the petitioner.

Mr. Bihani, learned counsel represents the CSTC.

Considering the submissions of the parties and the materials placed on records, this Court directs the remaining 60% of the provident fund dues to be disbursed within three months from the date of the

order along with interest @ 6% per annum with effect from November 1, 2022 (the date subsequent to the date of retirement of the petitioner) till date of actual payment of the balance 60%.

With the directions aforesaid WPA 11954 of 2023 is disposed of.

Since affidavits have not been invited in the present writ petition, the allegations made in the writ petition are deemed not to have been admitted by the parties.
