Petitioner approached this Court as there has been violation of the order dated 14.08.2024 passed by the West Bengal Real Estate Regulatory Authority, Calcutta.

The grievance of the petitioner is that the private respondent no. 5 has been violating the order of the authority and in spite of informing the police authorities no action has been taken.

Learned advocate appearing for the State submits that there are provisions of execution under the act which has been referred to.

Having considered that the authority is empowered to execute its own order, I am of the view that until and unless the petitioner applies to the

concerned authority for appropriate direction upon the police authorities, this Court under Article 226 of the Constitution of India will not invoke its jurisdiction.

Accordingly, WPA 11835 of is dismissed.
