Learned Counsel appearing for the petitioner submits that he is in custody for 14 years and he seeks parity with the co-accused, who have been granted bail.

Learned Counsel for the State opposed the bail prayer and contended that only one more witness requires to be examined and as such, if the petitioner is released on bail, there is serious chance of his abscondence, which will cause delay in disposal of the case.

Considering the period of incarceration suffered by the petitioner and that the co-accused persons are already on bail and that the evidence of material witnesses have already been recorded by the Court below, I am inclined to grant bail to the petitioner.

The petitioner, namely, Md. Zahid is granted bail upon furnishing a bond of Rs.50,000/- with two sureties of the like amount each, one of whom must be local, subject to the satisfaction of the learned Chief Judicial Magistrate, Alipore and on condition that the petitioner shall appear before the Trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The trial court shall be at liberty to impose any further condition to secure the attendance of the petitioner during trial. 5.

The application for bail being CRM (M) 1323 of 2026 is, thus, disposed of.
