Kausik (Rejected) CRM (M) 1355 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliganj Police Station Case No. 534 of 2025 dated 23.06.2025 under Sections 190/191(2)/191(3)/118(2)/109/103/305 of the BNS. And In the matter of : Sabir Sk @ Sabirul Sk ......Petitioner.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for almost 1 year. Till date witness action has not commenced. Petitioner is similarly situated as the other accused person who has been granted bail and there are no admissible evidence so far as the present petitioner is concerned which would call for further detention of the petitioner in connection with the instant case. Learned advocate for the State opposes the prayer for bail and submits that there were eye witnesses who have seen other accused persons including the present petitioner. Some of the accused persons were absconding which consumed time in tracing out the accused. Further, the accused persons were

influential persons in the locality who were enjoying postsuccess of elections and were hurling bombs which resulted in the child/deceased succumbing to bomb injury. Having regard to the ghastly nature of the crime which has been committed and the case diary reflecting list of witnesses which do not rule out the presence of the present petitioner in the assembly, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 1355 of 2026 is dismissed.
