Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 7 months. Earlier, he was granted bail but, however, his bail was cancelled. Thereafter, the petitioner surrendered in the year 2022 and since then he is in custody. So far as the progress of the trial is concerned, according to the petitioner, only one witness out of 24 witnesses cited in the charge-sheet till date has been examined.

Learned advocate for the de facto complainant submits that on several occasions the prayer for bail of the petitioner has been rejected.

Mr. Das, learned advocate appearing for the State submits a report which reflects that six criminal cases are pending against the accused including another case under Sections 364/34/302/201 of the Indian Penal Code.

Having regard to the fact that there are previous antecedents of the present petitioner including alleged commission of offence under Section 302 of the Indian Penal Code as also kidnapping, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM(M)1327 of 2026 is rejected at this stage. Report submitted by the State be kept with the record. A copy of the report be handed over to Mr. Mukherjee, learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
