Learned advocate appearing for the petitioner submits that the subject matter of the case involves recovery of 308 grams of brown sugar and the investigation of the case has already been concluded, as such, on any stringent conditions the petitioner may be released on bail.

Learned advocate for the State submits that charge has already been framed and dates are being fixed for examination of the witnesses.

Having considered that commercial quantity of contraband was recovered, I am of the opinion that Section 37 of the NDPS Act is attracted.

Consequently, the prayer for bail of the petitioner in CRM(NDPS) 631 of 2025 is dismissed.

However, the prosecution is directed to ensure the appearance of the witnesses on the date fixed so that the trial can be taken to its logical conclusion within a reasonable period of time. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
