The subject matter of the present case is alleged recovery of 35.712 kgs. of Ganja. Learned Advocate for the petitioner submits that the petitioner is in custody since 26.05.2025. Charge sheet has been submitted and charges have been framed. Although prosecution has relied upon fifteen witnesses to prove its case, till date no witness has been examined.

I have taken into account the quantum of seizure in the present case and the fact that the case is not progressing. In view of the charge having been framed, if there are no impediments, the learned trial court would complete the evidence of the seizure list witnesses within a period of three months from the next date fixed and if after examination of the seizure list witnesses the learned trial court is of the opinion that there has been dilution in the prosecution case, learned trial court would leniently consider the prayer for bail of the petitioner. However, the prayer for bail of the petitioner in CRM (NDPS) 1165 of 2026 is rejected at this stage.

The application for bail, being CRM (NDPS) 1165 of 2026 is, thus, disposed of.

Petitioner is granted liberty to communicate this order to the learned trial court.
