CAN 1 of 2025 is an application seeking modification of this Court's order dated 17th May, 2024 passed in WPA 12408 of 2024.

The modification is applied on the basis of the observations of a Division of this Court in MAT 1860 of 2019. The modification is to the effect that the interest on arrear family pension shall be paid @9% per annum from 1st November, 2010 till the date of issuance of the PPO. 3.

Since, this Court's order has been modified by a Division Bench in another proceeding, the order dated 17th May, 2024 passed by this Court shall stand modified accordingly.

The petitioners shall be entitled to interest on arrear family pension from 1st November, 2010 till the date of issuance of PPO. The order is modified accordingly.

In that view of the matter, it is expected that the Treasury Officer, Haldia paid interest on arrear family pension to the petitioners as directed above within a period of two weeks from the date of communication of a copy of this order.

Accordingly, CAN 1 of 2025 is disposed of.

Therefore, nothing further remains to be adjudicated in the contempt application.

Hence, the contempt application shall also stand disposed of.

9.

Personal presence of the alleged contemnors, if any, is dispensed with.

10.

Rule, if any, shall stand discharged.

11.

There shall be no order as to costs.
