C.R.M. (M) 530 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Islampur Police Station Case No. 226 of 2024 dated 18.03.2024 under Sections 467/471 of the Indian Penal Code.

The petitioner is in custody for more than a year and prays for bail.

Learned counsel for the State opposes the prayer. I have considered the material on record. The allegation against the petitioner is that he being the manager of Asirvad Micro Finance Limited misappropriated gold pledged with the company and issued fake/forged certificates in favour of several customers. A similar complaint was lodged against the petitioner earlier wherein he was granted bail on 16th January, 2024. The present complaint has been lodged on 18th March, 2024. It appears that several victims have fallen prey to the fraud and misappropriation practised by the petitioner. The petitioner appears to be a habitual offender. Investigation is still in progress.

Considering the material on record implicating the petitioner in the alleged offence, prayer for bail is rejected at this stage.

The application for bail is disposed of.
