Pursuant to the earlier order passed by this Court, learned advocate for the State has submitted a report which is taken on record.

Learned advocate appearing for the petitioner submits that the petitioner was arrested on 03.08.2025 and since then he is in custody. The accusation against the present petitioner is alleged recovery of 30.925 KGs of Ganja. According to the petitioner, till date charge has not been framed and the prosecution has relied upon 12 witnesses in order to prove its case.

Learned advocate appearing on behalf of the State opposes the prayer for bail and submits that all efforts would be exerted by the State to complete the trial.

Having considered the quantum of seizure in the present case, the prayer for bail is rejected at this stage. 5.

However, I direct the learned Trial Court to overcome the stage of consideration of charges within a reasonable time period, preferably within a month from the next date fixed. Thereafter, the learned Trial Court within a period of 45 days would give priority for examination of the seizure list witnesses. Petitioner would be at liberty to approach this Court after the examination of the seizure list witnesses are over.

With the aforesaid observations, CRM(NDPS) 1164 of 2026 is dismissed at this stage.

Case diary be returned to the learned advocate appearing for the State.
