Petitioner is in custody since 22nd December, 2024 and it has been alleged that there has been recovery of several types of contraband which is of commercial quantity. Charge sheet has already been submitted before the jurisdictional Court. Charges have been framed and only 1 witness has been examined out of the cited 7 witnesses. Learned advocate submits since the trial will consume substantial amount of time, the petitioner should be released on bail. On the other hand, learned advocate for the State opposes the prayer for bail and submits that the petitioner is a habitual offender and the present case attracts the rigors of Section 37 of the NDPS Act.

I have taken into account the various contrabands which have been seized in connection with the instant case as also the factum that the design with which the petitioner operated. Having regard to the fact that there are antecedent of the petitioner, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1169 of 2026 is dismissed.
