Learned advocate appearing for the petitioner submits that the seizure was from a vehicle which belong to the present petitioner and the said vehicle was lying with the police station from the date on which the co-accused was arrested in connection with other case. It has further been submitted that the petitioner is in custody in connection with the present case since 28th December, 2024 and the prosecution would take substantial time to take the trial to its logical conclusion as only 2 witnesses have been examined in the present case (evidence of 3rd witness is in progress and the prosecution, as a whole, intends to examine 10 witnesses).
Learned advocate for the State opposes the prayer for bail and submits that the materials appearing in the case diary reflect that it is the present petitioner who was operating a racket for receiving and distribution of contraband. The quantum of contraband so seized according to the State is of commercial quantity, rarely available.
I have taken into account the facts of the case as also that the petitioner has another criminal case pending against him relating to NDPS cases. Having considered the same, at this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 1170 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
