The prayer of the petitioner is opposed by respondent no. 7, a neighbouring resident, who submits that the building constructed at the said premises is a G+5 structure and is unauthorized. It is contended that no electricity connection ought to be granted in respect of an unauthorized construction.

The learned advocate appearing for the Howrah Municipal Corporation submits that although a sanctioned building plan exists for a G+1 structure, the petitioner and his associates have deviated from the approved plan and

constructed a G+5 building.

Since the petitioner seeks connection at the ground floor for which a santioned building plan exits, CESC Limited shall provide the electricity connection to the petitioner within three weeks from date. Respondent no. 5 is directed to extend necessary assistance for the same. The costs incurred for the police assistance required in this process shall be borne by the petitioner.

It is made clear that the petitioner shall comply with all requisite formalities before obtaining the electricity connection.

It is further clarified that the grant of this electricity connection shall not preclude the Howrah Municipal Corporation from initiating or continuing any action for demolition of the unauthorized portions of the building, in accordance with law.

Accordingly, WPA 11798 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
