Petitioner has approached this Court being aggrieved that the private respondents are trying to grab the property of the petitioner and also attempting to shut down his shop. To that effect, information was furnished to the local police authorities. However, no steps have been taken. State has submitted a report. Report reflects that a General Diary Entry was made by Kaliganj Police Station being G.D.E. No.569 dated 16.05.2025 and subsequently a proceeding under Section 126 of the BNSS has been drawn against the petitioner as also the private respondents.

The nature of the accusation so complained of is relating to a dispute which cannot be the domain of the police authorities. Petitioner would approach the jurisdictional civil and criminal courts for establishing his right. Police authorities are already in knowhow of the dispute between the parties. They would continue their surveillance and ensure that no untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations, WPA 11765 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
