Kausik (Allowed) CRM (M) 1331 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Karimpur Police Station Case No. 157 of 2024 dated 27.08.2024 under Sections 85/80/103/3(5) of BNS, 2023 and Sections 3/4 of Dowry Prohibition Act, 1961.

Learned advocate appearing for the petitioner submits that the petitioner is in custody since 17th December, 2024, charge sheet has already been submitted and the case has been committed to the Court of Sessions thereafter charges have been framed on 14.01.2026 and date has been fixed for witness action.

Learned advocate for the State opposes the prayer for bail and submits that the offences are heinous offences. The lady was forced to hang herself within 2 and a half months of marriage.

I have taken into account the case diary which includes the post-mortem report. Having considered the period of

detention and without entering into the merits of the case, I am of the view that as prosecution intends to examine 23 witnesses, some more time will be required to take the trial to its logical conclusion. As such, the prayer for bail of the petitioner is allowed.

Accordingly, Petitioner, namely, Suman Das @ Sumon Das shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Tehatta.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Trial Court.

Accordingly, CRM (M) 1331 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
