Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 11 months and till date, only 5 witnesses have been examined out of 20 witnesses cited in the charge-sheet.

Learned advocate appearing for the State produces the case diary and draws the attention of the Court to the statement of one of the eyewitnesses recorded under Section 164 of the Code of Criminal Procedure.

Petitioner is the sole accused and has inflicted blows upon the deceased which resulted in her death. The offence is gruesome as is surfacing from the materials collected in the case diary.

Having regard to the manner in which the offence has been committed as has been alleged in the prosecution

papers, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Learned Trial Court is directed to complete at least ten witnesses within a year from the date of communication of this order.

Petitioner will be at liberty to renew his prayer for bail after the aforesaid time period is over.

Case diary be returned to learned advocate appearing for the State.

The application for bail, being CRM (M) 1332 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
