Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than seven and a half months and the petitioner as well as the victim consumed alcohol and subsequently the petitioner has been falsely implicated in connection with the instant case. Learned advocate appearing for the de facto complainant opposes the prayer for bail and submits that the victim, a 14 years old girl, was forced to consume alcohol and thereafter she was ravished.

Learned advocate appearing for the State also opposes the prayer for bail and draws the attention of the Court to

the statement of the victim recorded under Section 183 of the BNSS as well as the medical report.

I have taken into account the materials appearing in the case diary as also the fact that charges have been framed and witness action is about to commence. Consequently the evidence of the victim has not yet commenced. At this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Petitioner would be at liberty to approach this Court after the evidence of vulnerable witnesses is over. The application for bail, being CRM (M) 1335 of 2026, is, thus, disposed of.
