Heard Learned Counsel appearing for the petitioner as well for the respondent no.3.

Learned Counsel appearing for the petitioner submits that the application being CAN 1763 of 2020 has been filed under Section 5 of the Limitation Act for condonation of delay. After considering the averments made in the application, delay in preferring this application for restoration is condoned. CAN 1763 of 2018 is disposed of.

Heard the learned counsel for the petitioner. Perused the petition. I am satisfied that sufficient averments have been made in the application for recalling the order dated 19th September, 2016. The order dated 19th September, 2016 is recalled and the application for recalling being CAN No.6593 of 2018 is allowed.

Let the writ petition being WPA 9172 of 2009 be

restored to the file. Let the matter appear in the monthly list of May, 2021.
