Kausik (Allowed) CRM (NDPS) 1175 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kalna GRPS Police Station Case No. 3 of 2025 dated 08.05.2025 under Sections 21(c)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year and 1 month and has been implicated in the present case on the basis of statement of co-accused from whom there was recovery of 1 Kg. of Heroin. It has also been contended that there are no materials except the statement of the co-accused. As such, the petitioner may be released on bail as the prosecution has cited 18 witnesses in support of its case and till date charges have not been framed.

Learned advocate for the State opposes the prayer for bail and submits that there were monetary transactions and Call Detail Records. So far as the Call Detail Records are concerned, I do not find any authorized person from the service

provider being present in the list of witnesses in the charge sheet. So far as the monetary trail is concerned, a sum of Rs. 7,000/- is seem to have been transacted between the present petitioner and the other co-accused. The prosecution case against petitioner is allegedly for receiving the quantum of contraband from the other co-accused who is in custody. Having considered the period of detention of the present petitioner and the materials which are appearing against him in the case diary, I am of the opinion that further detention of the present petitioner is unwarranted in the facts and circumstances of the present case.

As such, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Tarun Biswas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, 3rd Special Court (NDPS Act), Purba Bardhaman. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Purba Bardhaman without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1175 of 2026 is allowed. Report submitted be kept with the record.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
