In this application the petitioner has prayed for bail on the ground that he is in custody for about 1 year and 10 months and though the chargesheet has been submitted but the charge has not yet been framed. Therefore, he prayed for granting bail on any terms and conditions.

Learned counsel appearing on behalf of the NCB opposed the bail prayer contending that 152 kgs of Ganja was recovered from the joint possession of two accused persons. He further submits that trial is getting delayed as one of the accused

persons is still absconding and, therefore, the delay is attributable to the accused persons.

Having heard learned counsel for the petitioner and the NCB and considering the nature and gravity of the offence, the prayer for bail is rejected.

However, Trial Court is requested to split the case record in respect of absconding accused, if any, and to proceed with the trial without granting any unnecessary adjournments to either of the parties and the Trial Court will make its best endeavour to conclude the trial preferably within a period of six months from the next date of hearing.

The petitioner will be at liberty to renew his prayer for bail if there is no substantial progress of trial after six months. 6.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all requisite formalities.
