1. It appears from the record that several accused persons were granted bail by the Hon'ble Coordinate Bench. It further appears from the record that out of 18 witnesses, only five witnesses have been examined.

2. The learned Counsel for the State and the learned Counsel for the defacto complainant vehemently oppose the prayer for bail.

3. It appears that there is no chance of early conclusion of trial and other co-accused persons are also enlarged on bail.

4. In view of the above, the petitioners, namely, Sk. Sajjad and Sekh Saifulla @ Sk. Saifulla, shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, out of whom one must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Diamond Harbour, South 24Parganas and on condition that the petitioners shall meet the Inspector-in-Charge, Raidighi Police Station once in a week until further orders.

5. The petitioners shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence and/or commit any cognizable offence in any manner whatsoever.

6. In the event the petitioners fail to adhere to any of the conditions stipulated above without justifiable cause, the trial court shall be at liberty to cancel the petitioners' bail in accordance with law without further reference to this Court.

7. The application for bail is, accordingly, allowed.
