IN THE HIGH COURT AT CALCUTTA

Item No.67 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.

Rejected C.R.M. (M) 1336 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Chanchal Police Station Case No. 1458 of 2025 dated 05.12.2025 under Sections 64(2)(f)(m)/351(2) of the Bharatiya Nyaya Sanhita, 2023.

And In Re : XXXX alias XXXX Vs. The State of West Bengal & Anr. Mr. Soupal Chatterjee ... For the Petitioner.

Mr. Pradeep Kumar Banerjee, Mr. Bankim Pal ... For the State.

Affidavit-of-service filed on behalf of the petitioner be kept with the record.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for eight months, chargesheet has already been submitted and the petitioner has been falsely implicated in connection with the instant case by a daughter-in-law. Additionally, it has been submitted that the victim has refused medical.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.

I have taken into account the stage of the case wherein charge-sheet has been submitted, but yet the case has not been committed to the court of sessions. As such, at this stage, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

Learned Magistrate is directed to expedite the process of commitment after supply of documents under Section 207 of the Code of Criminal Procedure. Let the stage of consideration of charges be over within a period of 45 days after the case is committed to the court of sessions. Petitioner would be at liberty to approach this Court after the evidence of the victim is recorded. To that effect, learned Trial Court will expedite the process after consideration of the charges.

The application for bail, being CRM (M) 1336 of 2026, is, thus, disposed of.
