C.R.M. (M) 532 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kaliachak Police Station Case No.
71/2025 dated 14.01.2025 under Sections 126(2)/117(2)/118(2)/109/103/351(2)/3(5) of the Bharatiya Nyaya Sanhita and Sections 25/27/35 of the Arms Act. And In Re : Md.Golam Gausal Azam @ Jaisul & Others. Mr. Sekhar Basu Mr. Arup Kr. Bhowmick Mr. Tanmay Khan ... For the Petitioners.
Wasim Akram ... For the Defacto Complainant Mr. Ranadeb Sengupta Nahid Ahmed ... For the State.
Learned counsel for the petitioners submits that the petitioners are in custody for more than 4 months, more than 5 months and more than 3 months respectively. Charge sheet has been submitted. One of the co-accused has been granted bail by the learned Sessions Court. Further detention of the petitioner is not required.
Learned counsels for the State and defacto complainant oppose the prayer.
I have considered the material on record. Eye witnesses to the incident have implicated the petitioners. One of the injured has succumbed to his injuries. Co-
accused on bail does not appear to be on the same footing as the petitioners.
Considering the gravity of the offence and prima facie involvement of the petitioners therein, prayer for bail is rejected at this stage.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
