The Sub-Divisional Controller, Food and Supplies Department has filed a report in Court today wherein various reasons have been mentioned for not allowing the prayer of the petitioner.
It appears from the said report that the matter has been enquired by an inspection team including Area Inspector of the concerned area and the inspection report has been received on 31st August, 2021. The beneficiaries of the Fair Price Shop are not willing to cross the rail-line for taking their ration commodities due to the risk factor of crossing the railline. It has also been mentioned that the rail-line is a
busy one and there are several passenger as well as goods trains that crosses that place on regular basis. As it appears that the prayer of the petitioner has not been disposed of or decided finally by the competent authority, accordingly, the instant writ petition is disposed of by directing the Sub-Divisional Controller, Food and Supplies, Rampurhat to take a decision with regard to the prayer of the petitioner for shifting of his Fair Price Shop and godown and communicate the reasoned decision to the petitioner at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order. If required, the said respondent shall afford an opportunity of hearing to the petitioner for placing relevant documents in his support.
The writ petition stands disposed of.
