Petitioner has approached this Court being aggrieved by the inaction of the police authorities as petitioner alleges that the respondent no. 5 with the aid of forged documents is trying to grab the property and in spite of informing the police authorities, no effective steps have been taken to secure the interest of the petitioner.

State has submitted a report. Report reflects that information has been intimated to the Office of the BL&LRO, Bally, Jagachha, Belur Bazar, Howrah for verification in respect of the land in question.

Be that as it may, since the police authorities are only enquiring regarding the authenticity of the title of the property and the petitioner claims that on the basis of forged document the respondent no. 5 is trying to establish his dominion over the property, I grant liberty to the petitioner to approach the jurisdictional Magistrate under section 175(3) of the BNSS.

Learned Magistrate will assess and ascertain as to whether investigation is called for and thereafter pass necessary directions in accordance with law.

With the aforesaid observations WPA 12506 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
