Heard learned counsels for the parties.

The petitioner is in custody for more than a year and renews his prayer for bail.

Learned counsel for the petitioner submits that the petitioner is not the principal assailant and has not been named in the FIR. His name transpired in course of investigation.

Learned counsels for the State and the de facto complainant oppose the prayer.

I have considered the material on record. This is a case of mob lynching where the victim was assaulted and succumbed to his injuries. The petitioner appears to be a member of the gang which assaulted the victim.

This Court is informed that the co accused who have been granted bail earlier have been threatening the witnesses for which the order granting bail to them was modified directing them not to enter the jurisdiction of the local police station and not to contact any of the prosecution witnesses either physically or in any manner including electronic mode. 7 out of 23 witnesses have already been examined. Progress in trial is fairly satisfactory. Offences, if proved, shall attract mandatory life imprisonment. Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
