Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 6 months. He is aged about 64 years and till date only one witness has been examined out of 14 witnesses cited in the charge-sheet. Report submitted by the State be kept with the record. Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement under Section 183 of the BNSS as also the medical report which is available.

Learned advocate for the petitioner intends to draw the attention of the Court to other attending circumstances. Having considered the corroborative nature of evidence

available so far as the statement of the victim under Section 164 of Cr.P.C. and the medical report is concerned and the principles of law holding that sole testimony of the victim is sufficient in such cases, I am of the opinion that mere detention in the present case will not suffice the release of the petitioner. Accordingly, the prayer for bail of the petitioner in CRM(M)1337 of 2026 is dismissed.

Learned trial court would take steps to expedite the trial as was directed earlier by this Court.
