Petitioner Mr. Mrityunjoy Chatterjee Mr. Susnigdho Bhattacharyya ... for the petitioner Mr. Antarikhya Basu ... for the State Affidavit is placed on record. It appears from the affidavit petitioner had been arrested on 23.09.2021 in connection with Kaliachak Police Station Case No.1025 of 2021 dated 23.09.2021. It is further stated after the arrest in Kaliachak Police Station Case No.1025 of 2021 he was arrested in connection with the present case.

However, during the hearing of the application for anticipatory bail in the present case, this fact was not brought to the notice of the Court by either of the parties. Under such circumstances, the Court proceeded to grant prearrest bail to the petitioner in CRM 5578 of 2021. Be that as it may, we have considered the materials on record. Petitioner has criminal antecedents. He is in custody in connection with Kaliachak Police Station Case No.1025 of 2021 dated 23.09.2021. Keeping in mind the antecedents of the petitioner and other materials on record, we are of the opinion this is not a fit case to grant bail to the petitioner at this stage.

The application for bail is thus rejected.
