Madhuri Barai ... petitioner Mr. Sayan Banerjee Ms. Suparna Dutta ... for the petitioner Learned counsel for the petitioner submits that the petitioner is the wife of the private opposite party. As she was denied maintenance, she filed an application under Section 125 Cr.P.C. in 2022. Till date the same could not be disposed of. Even the issue of interim maintenance has not been decided yet. The matter has been pending for no fault of the petitioner.

No prejudice will be caused to anyone if a direction is passed to expedite the proceeding without directing service of notice upon the other side.

It appears that there is a delay in conducting the proceeding under Section 125 Cr.P.C.

In view of the above, the learned Magistrate is requested to conclude the proceeding as expeditiously as possible and more particularly, to decide the issue of interim maintenance

in accordance with law and at the earliest, preferably within a period of six months from the next date of hearing. Accordingly, the revisional application is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
