Petitioner(s) Mr. Soumya Nag Mr. Rajdeep Sengupta ... for the Petitioner(s) Mr. Anurag Sardar ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for more than three and half years and till date, only one witness out of the 17 witnesses cited by the prosecution, has been examined. It has also been submitted that the victim complained of is a 75-year-old widow and the accused is of 23 years.

Learned advocate for the State opposes the prayer for bail and has drawn the attention of the Court to the medical evidence which is appearing in the case diary and submits that the accused was identified in the T.I. parade apart from the statement of the neighbours.

Having considered the period of detention of the present petitioner and the manner in which the trial is progressing, I am of the opinion that there is no possibility

of the trial being concluded very soon, therefore, without entering into the merits of the case, the petitioner is directed to be released on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Golam Hasan Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, Alipore.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of South 24 Parganas without prior permission of the learned trial court.

Accordingly, CRM (M) 1342 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
