Mr. Sudipta Maiti ...for the petitioner Affidavit-of-service filed on behalf of the petitioner is taken on record.

In spite of service of notice upon the office of the learned Government Pleader State-respondents are not represented.

Mr. Sagnik Chatterjee, learned advocate is present in Court who normally represents State-respondents. Mr. Chatterjee is requested to enter appearance on behalf of the State-respondents and engagement of Mr. Sagnik Chatterjee be regularized by the office of learned Government Pleader.

Petitioner is a retired headmaster of a Government aided secondary school, who retired on superannuation on 30th November, 2020. After superannuation of the petitioner, Pension Payment Order was issued on 16th August, 2022 and based on such Pension Payment Order retiral dues including pensionary benefits have been released in favour of the petitioner. Petitioner claims interest on revised gratuity.

Accordingly, the Director of Pension, Provident Fund and Group Insurance, West Bengal and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioner on the gratuity from the date following the date of superannuation till the date of release of gratuity, within a period of 8 (eight) weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
