(M) 1357 of 2026 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Jamalpur Police Station Case No. 167 of dated 11.05.2026 under Sections 126(2)/117(2)/109(1)/352/351(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25/27 of the Arms Act (G.R. Case No. 2380 of 2026).
And In Re :
Sk. Azad Rahaman @ Sk. Ajad Rahaman ... Petitioner.
Mr. Rabi Sankar Chattopadhyay ... For the Petitioner.
Mr. P. Karan Singh ... For the State.
Learned advocate appearing for the State has produced the case diary.
I have taken into account the injury report which was not available at the time when the bail application of the petitioner was preferred before the coordinate Bench. The coordinate Bench, after assessment of all the materials, was pleased to grant interim bail to the petitioner by order dated 03.06.2026.
Having considered the materials appearing in the case diary, I am of the opinion that the prosecution has not made out any case for cancellation of the interim bail already granted.
Mr. Singh, learned advocate appearing for the State, on instructions, submits that there has been no violation of the conditions imposed by this Court.
In view of the aforesaid, the interim bail, granted on 03.06.2026, is hereby confirmed on the same terms and conditions as was granted by the coordinate Bench on 03.06.2026.
The application for bail, being CRM (M) 1357 of 2026, is, thus, disposed of.
The Investigating Officer of the case is present in Court. His further appearance before this Court is dispensed with.
Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
