The writ petitioners complain that the private respondent, who are the nephews of the petitioners were allowed to stay in their residence for quite sometime.

Since about May, 2020, the said nephews have been harassing the petitioners with a view to throw them out of their residence. Repeated complaints have been lodged since May, 2020 with the Haridevpur Police Station but no steps have been taken.

It is submitted by the Counsel for the State that FIR No. 185 has been lodged on 11th August, 2021 under Sections 341/323/506/114 of the Indian Penal Code. It is further submitted that the private respondents have obtained bail from the Additional Chief Judicial Magistrate, Alipore after surrender. It is, therefore, ordered that the investigation into the aforesaid FIR must be completed as

expeditiously as possible and preferably within a period of one month from the date of communication of a copy of this order and final report may be submitted to the Additional Chief Judicial Magistrate, Alipore.

This Court takes a grim view of the delayed registration of the FIR by the Haridevpur Police Station. Commissioner of Police, Kolkata shall look into the matter and take appropriate steps in this regard.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.

The petitioners shall communicate a copy of this order to the Commissioner of Police, Kolkata immediately.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
