Sl.19 11.06.2025 Court No.6 BP C.O. 1891 of 2025 Rajib Mitra -versusParul Mitra (Nayek) Mr. Sukanta Chakraborty Mr. Anindya Halder ... for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 3rd Court at Hooghly (Sadar) to dispose of the Matrimonial Suit No. 1944 of 2015 expeditiously which has been renumbered as Matrimonial Suit No. 380 of 2015.
The learned advocate appearing for the petitioner submits that the wife opposite party herein filed an application for alimony pendente lite being Misc. Case No. 29 of 2016. He further submits that a co-ordinate bench by an order dated November 16, 2018 in C.O. 1598 of 2018 disposed of the civil revisional application thereby affirming the part of the order whereby Rs. 7,000/- per month was granted as alimony pendente lite for the wife and Rs. 10,000/- as litigation cost but directed the trial court to consider the maintenance amount payable to the son of the parties upon hearing both sides. The learned advocate further submits that pursuant to the direction
passed in C.O. 1598 of 2018 no effective progress has been made till date.
From the order-sheets appended to this application this Court finds that 16th April, 2025 was fixed for hearing of the miscellaneous case.
The learned advocate for the petitioner further submits that next date for hearing of the miscellaneous case has been fixed in the month of July, 2025.
In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge.
In the light of the of the submissions made by the learned advocate for the petitioner, C.O. 1891 of 2025 stands disposed of by requesting the learned Additional District Judge, 3rd Court at Hooghly (Sadar) to make an endeavour to see that the Miscellaneous Case No. 29 of 2016 is disposed of as expeditiously as possible but preferably within a period of three months from the next date fixed in the said miscellaneous case without granting any unnecessary adjournments to either of the parties. After disposal of the miscellaneous case the learned trial judge is further requested to make an
endeavour to dispose of the Matrimonial Suit No. 380 of 2015 as expeditiously as possible keeping in the mind the fact that the instant matrimonial suit has been filed in way back in the year 2015.
No order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
