In Re: An application under Section 401/482 of the Code of Criminal Procedure.

Amantran & Ors.

Versus

Manik Chand Sharma & Anr.

The present revisional application is against the judgment and order dated 28.11.2011 passed by the learned Additional District and Sessions Judge, 7th Fast Track Court, Calcutta in Criminal Appeal No.4 of 2009.

Records of the revisional application reflect that the said appeal was preferred pursuant to the order of conviction and sentence passed by the learned Metropolitan Magistrate, 4th Court, Calcutta.

Today, when the matter has been taken up, none appears for the petitioners or for the opposite parties. As the issue of conviction and sentence is involved, I am not disposing of the case on merits. However, the revisional application being CRR 1755 of 2012 is dismissed for default. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

The learned Metropolitan Magistrate, 4th Court, Calcutta is directed to execute the order of sentence and compensation

passed in connection with the Complaint Case No.62 of 2002 (T.R. No.24 of 2002).

The Department is directed to communicate this order to the learned Metropolitan Magistrate, 4th Court, Calcutta. The learned Metropolitan Magistrate, 4th Court, Calcutta is directed to act on the server copy of this order. (Tirthankar Ghosh, J.)
