Petitioner is aggrieved by the fact that in spite of representation having been made to the Inspector-in-Charge, Beldanga Police Station as well as the Superintendent of Police of Murshidabad Police District, no steps have been taken by the concerned authorities except a General Diary Entry being Beldanga Police Station GDE No.24 dated 01.05.2025.
Learned advocate for the State submits a report. Let the report be kept with the record.
Learned advocate for the private respondent nos.5 to 8 submits that the same is a family feud and the dispute arose out of matrimonial discord. Having considered the admitted position that the respondent nos.5 and 6 happen to be the fatherin-law and the mother-in-law respectively, I am of the view that since the nature of the dispute complained of requires a preliminary enquiry to be conducted, petitioner should approach the jurisdictional Magistrate by invoking the relevant provisions of law. Learned jurisdictional Magistrate would conduct a necessary enquiry under the relevant provisions of the BNSS, thereafter assess regarding the nature of the accusations and pass necessary directions as to whether the criminal case is required to be continued. With the aforesaid observations, WPA 11821 of 2025 is disposed of.
There will be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
