The writ application has been preferred praying for direction upon the respondents to release and disburse the family pension along with all other retiral benefit along with interest @ 12% per annum.

In course of hearing the learned counsel for the respondent/EPF authorities has filed a report in the form of affidavit, wherein it is stated as follows:- "8. I state that as per Mannual of Accounting Procedure III of the Employees Provident Fund Organisation, the following documents are required to be submitted by the concerned writ petitioner, Aparna Dhali for claiming widow pension :- (i) The copy of the lodging of report with the concerned Police Station and a copy of the report obtained from the said concerned Police Station to the effect that the employee

concerned could not be traced out after all efforts has been made by the Police Authorities.

(ii) An indemnity bond from the beneficiary(ies) of the employee (here pensioner) that all payments will be adjusted against the payments due to the employee (here pensioner) in case he appears on the scene and makes any claim.

The petitioner has not yet submitted the above mentioned documents for claiming widow pension in the office of the Employees Provident Fund Organization, Regional Office, Howrah."

Accordingly, the writ application is disposed of with the direction that the writ petitioner shall provide all the required documents as stated in para 8 of the report submitted by the EPF authorities within 30 days from the date of this order and the authorities concerned shall decide the claim of the petitioner within 30 days thereafter, in accordance with law.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
