Krishna Halder v. The State Of West Bengal
22.06.2022.
48.
Ct.No.28.
as (Rejected) C.R.M. (DB) 1951 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ranaghat P. S. Case No.239 of 2022 dated 12.04.2022 under Sections 498A/304B/120B of the Indian Penal Code.
In the matter of : Krishna Halder.
.... Petitioner.
Mr. Tapas Maity.
...for the Petitioner.
Mr. Tanmoy Kr. Ghosh, Mr. Arindam Sen.
...for the State.
Heard the learned Counsels appearing on behalf of the parties.
Petitioner is in custody for about 70 days. It is submitted he has been falsely implicated in the instant case. Learned Advocate for the State opposes the prayer for bail.
We have considered the materials on record. Statements of witnesses show petitioner-husband had subjected the victim housewife to torture over demands of dowry. He also had an illicit relationship with another lady.
In view of the aforesaid incriminating materials connecting the petitioner with the crime, we are of the opinion that this is not a fit case to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected at this stage.
