Petitioner made transfer application in the prescribed format in the month of March, 2025 and the concerned school authority has issued "No Objection" on 26th March, 2025. It is submitted on behalf of the petitioner that vide letter dated 2nd April, 2025 school authority forwarded transfer application of the petitioner to the District Inspector of Schools (SE), Malda being respondent no. 3 for taking steps. Prayer is made for giving direction upon respondent authorities for consideration of transfer application of the petitioner.
State respondents, West Bengal Board of Secondary Education and West Bengal Central School Service Commission are represented by learned advocates.
It is submitted on behalf of the respondents that since issue is pending before respondent no. 3 same needs to be forwarded to West Bengal Central School Service Commission for taking decision.
In view of respective submissions made on behalf of the parties, respondent no. 3 is directed to forward transfer application of the petitioner in off-line mode to the Chairman of West Bengal Central School Service Commission being respondent no. 7 by fortnight from date, if same has not yet been forwarded. On receipt of transfer application, respondent no. 7 is directed to take decision on the transfer application within a period of six weeks thereafter. Decision to be taken by respondent no. 7 shall be communicated to the petitioner by fortnight thereafter.
However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.
Writ petition is disposed of.
There shall be, however, no order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
