(NDPS) 687 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with NCB Crime No. 12/NCB/KOL/2021 dated 07.04.2021 under Section 8( c ) read with Sections 20(b)(ii)(C)/28/29 of the NDPS Act. And In Re : Swapan Biswas ..... petitioner Mr. Biswajit Goswami ... for the petitioner Mr. Amajit De ... for the NCB Statements of witnesses and contemporaneous documents show recovery of narcotic substance i.e. 215 kgs. of Ganja above commercial quantity from the vehicle of the petitioner. He was also driving the vehicle. In view of the aforesaid incriminating materials and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.
